The Case Against the Income Tax
Could America exist without an income tax? The idea seems radical, yet in truth America did just fine without a federal income tax for the first 126 years of its history. Prior to 1913, the government operated with revenues raised through tariffs, excise taxes, and property taxes, without ever touching a worker's paycheck. In the late 1800s, when Congress first attempted to impose an income tax, the notion of taxing a citizen's hard work was considered radical! Public outcry ensued; more importantly, the Supreme Court ruled the income tax unconstitutional. Only with passage of the 16th Amendment did Congress gain the ability to tax the productive endeavors of its citizens.
Yet don't we need an income tax to fund the important functions of the federal government? You may be surprised to know that the income tax accounts for only approximately one-third of federal revenue. Only 10 years ago, the federal budget was roughly one-third less than it is today. Surely we could find ways to cut spending back to 1990 levels, especially when the Treasury has single year tax surpluses for the past several years. So perhaps the idea of an America without an income tax is not so radical after all.

what the IRS claims gives its authority to exist [ the 16th amendment]
was never ratified by all the states therefor it is unjust, and illegal taxation
also in the IRS code one has to ''voluntarily comply''
so its not mandatory
its also not apportioned tax
not to mention on 2 different occasions the supreme court ruled that income tax is unconstitutional

also, there is no law on the books that state you are required to file a tax form each year. It's not against the law to not report your income.

Well, how can you not volunteer to be taxed when your employer holds the tax from your wages before you ever get your paycheck?
Sounds mandatory to me.

Great post. I seriously hope one day Americans will wise up and vote for officials who support a tax on consumption to replace an income tax. There have been a few politicians touting the idea (I think even Bush has considered it) but it's not quite important enough to the public. As the IRS continues to burden the public and as politicians continue to TAKE money from the taxpayers' pockets, I think it will eventually become a major issue.
also, there is no law on the books that state you are required to file a tax form each year. It's not against the law to not report your income.
And how many people go to jail each year for tax evastion? I wonder what Al Capone would have to say about NOT paying taxes.
FYI - there are laws that address income tax:
The federal tax laws are contained in Title 26 of the United States Code, which is the compilation of laws passed by the Congress (“Title” basically means “Volume” when applied to the U.S. Code as a whole, so Title 26 is what might more casually be called Volume 26). The most important statutory provision with regard to income taxes is section one of the tax code, 26 U.S.C. § 1. This is the section that actually imposes the income tax. It’s very simply written. If you are unmarried, the relevant provision is § 1(c), which states: 26 U.S.C. § 1
There is hereby imposed on the taxable income of every individual . . . who is not a married individual a tax determined in accordance with the following table:

Furthermore, the Constitution clearly gives Congress the authority to tax:
Section 8 - Powers of Congress
The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

My taxes get taken out of my check. If my employer or the government gets it wrong, it's their fault, not mine....so, that means I am paying, and the congress is collecting. I shouldn't have to figure out if I gave them the right amount or not, or be penalized for not reporting to the government each year.
I didn't say one does not have to pay taxes, I said that there is no law on the books that say it is a requirement of each working citizen to send in a tax return each year. If you are not required to file a return, then also you are not required to report your earnings. It is up to your employer to make sure enough taxes are being taken out of your paycheck and to submit your earnings to the IRS.
In the case of self-employment, I would consider it obligatory though... If you are earning money, whether illegally or legally, and it is not being reported, (like Capone) then yes, I believe you are breaking the law...

Might not be in the law books, but try not filing your taxes. You might find the authorities knocking at your door.

Well, I render under Caesar, what he says is his, (from my paycheck) - other than that, they don't need anything else from me....I'm just a small fish, and they don't go after those ones.... (usually.....:twitch)
