Court: Family's religious beliefs 'no evidence' of 1st Amendment violation

A California court has ruled that several children in one homeschool family must be enrolled in a public school or "legally qualified" private school, and must attend, sending ripples of shock into the nation's homeschooling advocates as the family reviews its options for appeal.
The ruling came in a case brought against Phillip and Mary Long over the education being provided to two of their eight children. They are considering an appeal to the state Supreme Court, because they have homeschooled all of their children, the oldest now 29, because of various anti-Christian influences in California's public schools.
The decision from the 2nd Appellate Court in Los Angeles granted a special petition brought by lawyers appointed to represent the two youngest children after the family's homeschooling was brought to the attention of child advocates....

I am keeping an eye out on this case. I wonder if this family ever legally tried to home school in this state or if they just went and started schooling.
I will be praying for this family and all in my state of California.
There may be a mass home schooling jump soon as this state will start cutting schools funding again.
I pray that those who start do it in the legal way and join groups such as HSLDA or CHEA.
We must band in numbers. The pioneers in this state worked so hard for us to have this chance and then we run to our homes and hide.
I am one for staying out of the lime light but if it's as simple as joining a group or two I am more than willing to do so. ( member of HSLDA and CHEA currently)
The groups just report number not names to the state.

So what do you have to do in California to homeschool. I live in MD and it is simple. Just file a letter of intent with the county board of ed. I also belong to an oversite group that takes care of all my paper work.
I was also wondering what this family did to get into this trouble. I couldn't find anything that stated what offence there was. I thought that maybe it was that she wasn't certified, but wasn't sure. I didn't seem clear. But I read it in a hurry.

California: Unfortunate Court Decision in California
Dear HSLDA Members and Friends:
The Second Appellate District in Los Angles County handed down a
decision on February 28 involving a non-member homeschool family that
has caused much concern among California homeschoolers.
Home School Legal Defense Association is looking at the background of
the case to determine the implications of this particular decision by
the Second Appellate District for the homeschool community in
California.
We do want to make one point clear, however. Nothing has changed in
California regarding your homeschool. HSLDA maintains that the advice
we give homeschool families is accurate and that filing a private
school affidavit, or enrollment in a private school independent study
program (I.S.P) is a valid option under the law in California.
We will be examining this situation and providing a detailed analysis
of this court decision in the near future.

Follow Up—Bad Decision by Second Appellate District of California
As many of you know, the Second Appellate District Court of Los Angeles handed down a very bad decision regarding a case involving a homeschool family.
Home School Legal Defense Association was not involved with this case, and the family are not members, which is why we only heard about this case when the opinion was released on February 28, 2008.
Since legal cases have many facets, and we are starting from scratch, it takes time to investigate and fully absorb all the facts which led up to a particular decision. We are in the middle of that process, but because of the interest in this case we want to give you as much information as we can regarding the implications for California.
The opinion holds that homeschooling is not a legal option in California....

I also would like to know what happened to get them on the "radar" so to speak.
Perhaps the parents did do something wrong...but even if they did the opinion of the court was wrong.

A "breathtaking" ruling from a California appeals court that could subject the parents of 166,000 students in the state to criminal sanctions will be taken to the state Supreme Court.
The announcement comes today from the Pacific Justice Institute, whose president, Brad Dacus, described the impact of the decision as "stunning."
"The scope of this decision by the appellate court is breathtaking," he said. "It not only attacks traditional homeschooling, but also calls into question homeschooling through charter schools and teaching children at home via independent study through public and private school."
